We have established these guidelines and terms of use that follow to help our participants achieve a better sense of community. If you disagree with some of the opinions expressed by a member of the Pelican Community, we encourage you to create your own free PelicanCities Home Page and make your own views known. To us, this exchange of ideas is the definition of a community. Content Guidelines Pelican Parts has carefully developed the following web page content guidelines to promote the free-flowing exchange of information about automobiles around the world If you have any questions regarding these guidelines, please don’t hesitate to email us at pelicanparts@csi.com The following is not permitted on and member’s PelicanCities web pages: 1.Displaying pictorial or descriptive material containing nudity or pornographic material of any kind. 2.Providing material that is obviously offensive to the online community, including bigotry, prejudice, racism, hatred or extremely excessive profanity. 3.Displaying material that exploits children under 18 years of age for harmful or sexual purposes. 4.Promoting or providing instructional information about illegal activities. 5.Committing acts of copyright, trademark, patent, trade secret or other intellectual property infringement. 6.Defaming any person or group. 7.Developing restricted or password-only access pages, or hidden pages or images (those not linked to from another accessible page). 8.Using your home page (or directory) as storage for remote loading or as a door or signpost to another home page, whether within PelicanCities or not. 9.Developing home pages or session posts that consist of hyperlinks to content not condoned or allowed in these PelicanCities guidelines. 10.Having accounts with PelicanCities. 11.Using PelicanCities to gather or disseminate personal information on users for commercial gain. 12.Posting or disclosing any personal identifying information belonging to children. 13.Violating Internet standards for the purpose of promoting your home page. This includes ‘spamming.’ 14. Engaging in commercial activities that are beyond a small scale, and/or compete with Pelican Parts’ primary business of selling ‘NEW’ parts. You may post cars for sale, and also may sell used parts, but you may not use this space for commercial reasons if you sell new parts (regardless of whether you do it on the site or not) as a business venture. Pelican Parts reserves the right to suspend or remove any page from the system which is brought to our attention and which we find, in our sole discretion, violates any of these page content guidelines or otherwise is in violation of the law. Pelican Parts does not actively monitor the content of the PelicanCities Home pages, but will investigate inquiries concerning violations of this agreement, when so alerted to them. Pelican Parts is not responsible or liable for any loss of data resulting from our deletion of material from the Pelican Parts Server, network or system outages, file corruption or any other reasons. We urge all members to maintain backup versions of their home pages to guard against losses of any kind. 1. PelicanCities home pages are available to persons 16 years of age or older, and persons under the age of 16 who have provided Pelican Parts with evidence of their parent’s or guardian’s express consent to obtain membership. Pelican Parts reserves the right to suspend any account if the primary user is found to be under the age of 16. 2.The opinions and views expressed in the home pages do not reflect those of Pelican Parts. The contents of the home pages within PelicanCities are not reviewed in any manner prior to posting to the server. 3.Pelican Parts is not responsible for the content of any home pages. Members are solely responsible for everything contained in their own home pages. Members may be held legally liable for the contents of their Personal Home Pages and may be held legally accountable if their home pages include, for example, defamatory comments or material protected by copyright, trademark, patent or trade secret law without the express permission of the author or owner. 4.Pelican Parts is not responsible for the delivery of any goods or services sold or advertised through its member’s home pages. 5.Pelican Parts does not actively monitor the content of any of the home pages, but will investigate complaints that arrise from violations of this agreement, or general complaints. Send complaints to: pelicanparts@csi.com 6.By agreeing to this agreement, the member agrees to indemnify and hold harmless Pelican Parts for any loss, liability, claim, damage, and expenses (including reasonable attorneys’ fees) arising from or in connection with the contents of the member’s home page. Note that the Porsche Crest is a tradmark of PCNA and may not be used on any home pages without the express permission of PCNA. 7.Pelican Parts is not responsible or liable for any loss of data, nor is it required to return any data, resulting from our suspension or deletion of home pages, network or system outages, file corruption or any other reasons. We urge all members to maintain backup versions of their home pages to guard against losses of any kind. 8.Accounts may be suspended for excessive network traffic. If there is an account that generates excessive traffic, the user may be requested to pay for the charges associated with the bandwidth usage. Note that we will be monitoring the bandwidth of all users. Page Content Requirements In return for all the great services we offer, there are only two main requirements that we ask of our PelicanCities members: You must display the Pelican Parts hosting logo on the bottom of all pages, and include the home page link back to our home page. This form of ‘advertising’ allows us to keep the sites free. This is subject to change at any time. Intellectual Property Dispute Policy In the event that Pelican Parts receives a complaint that the content of a home page allegedly infringes intellectual property rights or is otherwise unlawful, Pelican Parts may request written substantiation of the complaint from the complaining party, for example, substantiation of proof of ownership in the form of a trademark, service mark, patent or copyright. Pelican Parts will take the steps it believes to be appropriate under the circumstances, including, for example: 1.Suspending the site, or a portion of the site, immediately until the dispute is resolved; 2.Providing the member with contact information for the complaining party; 3.Instructing the member to contact the complaining party to resolve the dispute; 4.Informing the complaining party of our actions and ask that party to work directly with the member; Note: All correspondence between the parties must also be sent to Pelican Parts at pelicanparts@csi.com 5.Taking the following action based on the progress of the dispute: If the member has not pursued resolution within 14 days of a notification, the site, or portions of the site, will be deleted; If the complaining party has not pursued resolution within 14 days of the member’s response, the site, or portions of the site, will be re-activated; If legal action is pending or the dispute is not settled, the site, or portions of the site, may remain suspended until resolution is reached and Pelican Parts is notified by both parties as to the outcome; If a resolution is reached between the parties, the site, or portions of the site, will be reactivated with any mutually agreed upon modifications. If a copyright, trademark, patent, or other infringement is obvious (such as when pirated computer programs or information used to circumvent manufacturer-installed copy-protect devices, including serial or registration numbers for software programs or any type of cracker utility, is being distributed), Pelican Parts also reserves the right, instead of following the above stated procedures, to delete all files and remove the Homesteader without any warning. Other Rights Reserved Pelican Parts also reserves the following rights: To amend or change these Pelican Parts service guidelines at any time and WITHOUT notice; To release current or past member information if Pelican Parts believes that a member’s account is in violation of the Pelican Parts guidelines, is being used to commit unlawful acts, if the information is subpoenaed and/or if Pelican Parts deems it necessary and/or appropriate; To remove members for conduct that Pelican Parts believes is harmful to other members, to non-members or to Pelican Parts as a business; To remove members who interfere with the design and operation of the Pelican Parts Website or the advertising banner.
